1. Acceptance

By accessing or using LovedTwice, you agree to these Terms.

2. Eligibility

You must be at least 16 years old to use LovedTwice in Germany/EU.

3. The Service

LovedTwice enables sustainable sharing, creative reuse, and ArtDrop Hunts. ArtDrop Hunts include Mystery Hunts hosted inside consenting partner venues (LovedTwice Hubs) and Exploration Hunts placed in outdoor locations by users. We provide tools to post items, share stories, and connect with the community.

4. Your Account

You are responsible for your account, credentials, and the accuracy of your information.

5. User Content and License

You retain ownership of your content. You grant LovedTwice a worldwide, non-exclusive license to host, display, and distribute your content to operate the service.

6. Community Rules

• No illegal, unsafe, hateful, harassing, or misleading content.
• No infringement of intellectual property or privacy rights.
• No spam, scams, or attempts to exploit or harm others.

7. ArtDrop Hunts

7.1 Mystery Hunts (Venue-Based): Mystery Hunts must be placed only inside consenting partner venues (LovedTwice Hubs). Follow venue rules and safety guidelines.

7.2 Exploration Hunts (Outdoor): Exploration Hunts may be placed in outdoor locations by users. When placing an Exploration Hunt, you are solely responsible for:

• Choosing a safe, publicly accessible location that does not endanger others
• Checking local regulations regarding the placement of objects in public or private spaces
• Obtaining permission from landowners or property managers where required
• Retrieving the item if it remains unclaimed
• Not placing items in environmentally protected areas, on private property without consent, or in locations that could cause damage, litter, or safety hazards

7.3 Platform Role: LovedTwice provides a platform for users to organize ArtDrop Hunts. We do not verify, endorse, or guarantee the legality or safety of any placement location. Users participate and place items at their own risk.

7.4 General Rules: Do not place items in public spaces or private property without consent. All ArtDrop items must be family-friendly, legal, and safe to handle. LovedTwice reserves the right to remove any hunt that violates these terms.

8. Live Sessions

8.1 Artist Responsibility: When you use the "Go Live" feature to share your location and artistic activity, you are solely responsible for:

• Checking local regulations regarding public performances and street art
• Obtaining any required permits (e.g., Sondernutzungserlaubnis in Germany)
• Complying with all applicable laws in your jurisdiction

8.2 Platform Role: LovedTwice acts as an information society service under EU Regulation 2022/2065 (Digital Services Act). We provide a platform for artists to share their location and do not verify, endorse, or guarantee the legality of any artistic activities.

8.3 No Legal Advice: Information about permits or regulations provided through the app is for informational purposes only and does not constitute legal advice.

9. ReLoved Exchanges

ReLoved items are shared between users. Arrange safe handoffs in public places. LovedTwice is not a party to exchanges. No cash sales unless explicitly allowed by the platform.

10. LovedGoods Orders (if enabled)

Orders are points-based. Shipping address data is used for fulfillment. Items and availability may change.

11. Reporting and Moderation

Users can report content. We may remove content, restrict features, or suspend accounts for violations.

12. Termination

We may terminate or suspend access for violations of these Terms.

13. Disclaimer

The service is provided "as is" without warranties to the extent permitted by law.

14. Limitation of Liability

To the extent permitted by law, LovedTwice is not liable for indirect or consequential damages.

15. Changes

We may update these Terms; the effective date will be updated.

3. Dienstbeschreibung

LovedTwice ermoglicht nachhaltiges Teilen, kreative Wiederverwendung und ArtDrop Hunts. ArtDrop Hunts umfassen Mystery Hunts in zustimmenden Partner-Venues (LovedTwice Hubs) und Exploration Hunts, die von Nutzern im Freien platziert werden. Wir bieten Funktionen zum Posten, Storytelling und Community-Austausch.

4. Konto

Du bist fuer dein Konto, deine Zugangsdaten und korrekte Angaben verantwortlich.

5. Inhalte und Lizenz

Du behaeltst die Rechte an deinen Inhalten. Du raeumst LovedTwice eine weltweite, nicht-exklusive Lizenz ein, deine Inhalte fuer den Betrieb des Dienstes zu hosten, anzuzeigen und zu verbreiten.

6. Community-Regeln

• Keine illegalen, gefaehrlichen, hasserfuellten, belaestigenden oder irrefuehrenden Inhalte.
• Keine Verletzung von Rechten Dritter oder Privatsphäre.
• Kein Spam, Betrug oder Missbrauch.

7. ArtDrop Hunts

7.1 Mystery Hunts (Venue-basiert): Mystery Hunts duerfen nur in zustimmenden Partner-Venues (LovedTwice Hubs) platziert werden. Beachte die Venue-Regeln und Sicherheitshinweise.

7.2 Exploration Hunts (Outdoor): Exploration Hunts koennen von Nutzern im Freien platziert werden. Beim Platzieren eines Exploration Hunts bist du allein verantwortlich fuer:

• Die Wahl eines sicheren, oeffentlich zugaenglichen Standorts, der andere nicht gefaehrdet
• Die Pruefung lokaler Vorschriften bezueglich der Platzierung von Gegenstaenden in oeffentlichen oder privaten Raeumen
• Das Einholen der Erlaubnis von Grundstueckseigentuemern oder Verwaltern, wo erforderlich
• Das Zurueckholen des Gegenstands, falls er nicht abgeholt wird
• Keine Platzierung in Naturschutzgebieten, auf Privatgrundstuck ohne Zustimmung oder an Orten, die Schaeden, Vermuelllung oder Sicherheitsrisiken verursachen koennten

7.3 Rolle der Plattform: LovedTwice stellt eine Plattform fuer Nutzer bereit, um ArtDrop Hunts zu organisieren. Wir ueberpruefen, befuerworten oder garantieren nicht die Rechtmaessigkeit oder Sicherheit eines Platzierungsorts. Die Teilnahme und Platzierung erfolgt auf eigenes Risiko.

7.4 Allgemeine Regeln: Keine Platzierung in oeffentlichen Bereichen oder fremdem Eigentum ohne Zustimmung. Alle ArtDrop-Gegenstaende muessen familienfreundlich, legal und sicher in der Handhabung sein. LovedTwice behalt sich vor, jeden Hunt zu entfernen, der gegen diese Bedingungen verstoesst.

8. Live Sessions

8.1 Verantwortung des Kuenstlers: Wenn du die "Go Live"-Funktion nutzt, um deinen Standort und deine kuenstlerische Aktivitaet zu teilen, bist du allein verantwortlich fuer:

• Die Pruefung lokaler Vorschriften fuer oeffentliche Auffuehrungen und Strassenkunst
• Das Einholen erforderlicher Genehmigungen (z.B. Sondernutzungserlaubnis in Deutschland)
• Die Einhaltung aller geltenden Gesetze an deinem Standort

8.2 Rolle der Plattform: LovedTwice agiert als Dienst der Informationsgesellschaft gemaess EU-Verordnung 2022/2065 (Digital Services Act). Wir stellen eine Plattform bereit, ueber die Kuenstler ihren Standort teilen koennen, und ueberpruefen, befuerworten oder garantieren nicht die Rechtmaessigkeit kuenstlerischer Aktivitaeten.

8.3 Keine Rechtsberatung: Informationen ueber Genehmigungen oder Vorschriften in der App dienen nur zur Information und stellen keine Rechtsberatung dar.

9. ReLoved-Austausch

ReLoved-Items werden zwischen Nutzern ausgetauscht. Vereinbart sichere Treffen an oeffentlichen Orten. LovedTwice ist keine Vertragspartei. Keine Barverkaeufe, sofern nicht explizit durch die Plattform erlaubt.

10. LovedGoods-Bestellungen (falls aktiviert)

Bestellungen erfolgen punktebasiert. Versanddaten werden zur Erfuellung genutzt. Artikelverfuegbarkeit kann sich aendern.

11. Meldungen und Moderation

Inhalte koennen gemeldet werden. Wir koennen Inhalte entfernen, Funktionen einschraenken oder Konten sperren.

12. Beendigung

Wir koennen den Zugang bei Verstoessen sperren oder beenden.

13. Haftungsausschluss

Der Dienst wird "wie besehen" bereitgestellt, soweit gesetzlich zulaessig.

14. Haftungsbegrenzung

Soweit gesetzlich zulaessig, haften wir nicht fuer indirekte oder Folgeschaeden.

15. Aenderungen

Wir koennen diese Bedingungen anpassen; das Datum wird aktualisiert.
